Abstract: Initially, the article presents a parallel between judicial and arbitral proceedings as means of dispute resolution, outlining the similarities and differences between both systems. The author then investigates the viability of using in arbitration the legal instrument that confers upon a judge authority to grant a remedy that ensures the effects of a final award in advance - "antecipação da tutela". The definition and development of this measure in Brazilian law, and the problems of its use in arbitration are also analyzed. Further, a comparison between partial awards and advancing awards or "tutela antecipada", the requirement that a provision allowing the advancing of awards be contemplated in the arbitral agreement, the effects of the omissive agreement, the rules concerning this issue in several arbitral institutions, and lastly, granting the measure without hearing the counterparty, are the main topics of this study.
