Advocacy from the arbitrator's perspective: what is helpful and what is not

Abstract: The present work discussed advocacy from an arbitrator's perspective, from the following standpoints: (i) advocacy in the context of written submissions, addressing their length, structure and dealing with the facts of the case; (ii) advocacy in opening and closing statements, discussing the ideal behavior by counsel towards arbitral tribunals when presenting their case; (iii) the role advocates play in the production of oral evidence, including direct and cross examination of fact and expert witnesses.
