O dever de revelação é essencial para garantir a independência e a imparcialidade do tribunal arbitral. Contudo, há divergências se a não revelação, por si só, pode evidenciar a parcialidade dos árbitros e, consequentemente, causar a invalidade da sentença arbitral. Os propósitos do presente artigo são: (i) analisar se a validade de sentença arbitral proferida por árbitro(a) que descumpre seu dever de revelar possível conflito de interesses fica de algum modo impactada; e (ii) investigar possibilidades de sanção adequada ao/à árbitro(a) que descumpre seu dever de revelação.
