After a short introduction (Section I), the paper provides a brief, yet comprehensive, overview of arbitration in Brazil (Section II). Section II covers the following subjects of interest: the scope of application of the Brazilian Arbitration Act (II.A); subject-matter arbitrability and choice of law (II.B); formal and substantive validity of arbitration agreements (II.C); appointment and challenge of arbitrators (II.D); certain procedural aspects of the arbitration proceeding, such as the key features of the rules of domestic arbitral institutions as well as rules and practices concerning the taking of evidence, confidentiality and the calculation and apportionment of costs (II.E); interim measures and court assistance, including with respect to evidence gathering, also touching briefly on anti-arbitration injunctions (II.F); the grounds for setting-aside an arbitral award and available remedies (II.G); recognition and enforcement of arbitral awards (II.H). Section III concludes with a few remarks on the outlook of arbitration in Brazil.
